Orange County, California, offers two types of marriage licenses. The first is a public marriage license, which can be used to marry anywhere in the state. As a public record, a copy of the marriage license can be obtained by anybody. The second type of license is a confidential marriage license. Only the couple can obtain a copy of this license. In order to receive a confidential marriage license the couple must be living together prior to the ceremony, and the ceremony must take place in Orange County. The process for obtaining either type of marriage license is the same.

Things You'll Need

  • Valid form of photo identification, such as a passport or driver's license
  • Divorce decree or death certificate of prior spouse, if applicable
  • Cash, check or credit card for fee

Instructions

      Decide which type of marriage license to obtain. If the couple does not live together or is marrying outside of Orange County, a public license must be used. For couples who live together and are marrying inside of Orange County, a confidential license may be chosen.

      Fill out the marriage license application. The application is available online.

      Appear together and in person at the Old Orange County Courthouse. Appointments are not necessary, and applicants who have completed the marriage license application online are given priority.

      Present photo identification and any divorce or death certificates from prior marriages. Pay the fee by cash, check, money order, cashier's check or credit card. The marriage license will be issued within 20 to 40 minutes and is valid for 90 days.
