Arizona marriage laws are the results of actions taken by the Arizona State Legislature. The laws are set forth in Title 25, Marital and Domestic Relations. These laws govern anyone desiring to be married in the state of Arizona. Section 25 to124 titled "Persons authorized to perform marriage ceremony- definition" lists the categories of persons who can marry couples in Arizona.

1. Clergymen

   • Clergy who are licensed or ordained can marry couples in Arizona. The statute, 25-124, defines a "licensed or ordained clergymen" as "ministers, elders or other persons who by the customs, rules and regulations of a religious society or sect are authorized or permitted to solemnize marriages or to officiate at marriage ceremonies."

   Judges

   • Title 25-124 names a list of judges who can marry couples in Arizona. The list includes judges of courts of record, municipal court judges, justices of peace, justices of the U.S. Supreme Court, judges of a court created by an act of congress, bankruptcy and tax court judges, U.S. Magistrate judges and judges of the Arizona Court of Military Appeals.

   Marriage Ceremony

   • Title 25-125 requires that in addition to the couple and the person authorized to marry the couple, two witnesses at least 18 years of age must attend the ceremony. At the conclusion of the ceremony, the couple, the person performing the marriage and both witnesses must sign the marriage license.

   Who Can Be Married

   • Under Title 25-101, Void and Prohibited Marriages, the Arizona Legislature lists those couples who cannot marry. One category includes close relatives, such as parents and children, brothers and sisters -- even half-brothers and sisters -- uncles, nieces, aunts and nephews. In addition, couples cannot be first cousins unless both are over the age of 65. If one is over and one is under 65, then approval is required by a superior court judge upon proof that one of the parties is unable to reproduce. The other category of prohibited couples are members of the same sex.
